1. General Terms.
In consideration of hosting services to be delivered, Customer agrees to be bound by the following terms and conditions:
1.1. Customer agrees to pay, in advance of each monthly or yearly service term (Customer’s discretion), for hosting services to be rendered.
1.2. Customer agrees to be bound by the service term selected on the online order form or via applicable promotional codes that may require Customer to order 7HostingPH.com’s service for a certain minimum period of time.
1.3. Customer agrees to a no-refund policy in advance. Setup fees and monthly web hosting service fees are non-refundable.
1.4. Non-Payment of services shall result in a 7-day notice of disconnection. All payment failures must be cured within 7 days of notice.
1.5. 7HostingPH.com is not and shall not be responsible for data integrity for any accounts that are terminated, disconnected, or interrupted because of Customer’s failure to pay for 7HostingPH.com’s services.
1.6. Customers agrees to pay all tax applicable to your account (tax is included in all costs quoted on 7HostingPH.comwebsite).
2.1. Establishment and provision of service is contingent upon receipt of payment from Customer to 7HostingPH.com.
2.1.1. Customer must pay in full for the Services before 7HostingPH.com begins to provide the Services to Customer.
2.1.2. Setup fees will be charged and are due at the time of the Customer’s initial request of the Services requiring setup, unless specified that no set up fees are due.
2.2. Payment is due on the defined monthly or recurring billing date of each month.
2.2.1 Hosting Renewal charges will occurs at the due date automatically. If automatic credit card charging on the due date fails, Service will be interrupted on accounts that reach 7 days past due.
3. Delinquent Accounts.
3.1 7HostingPH.com may temporarily deny service or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve Customer of responsibility for the payment of all accrued service fees, and any collection fees to which 7HostingPH.com may be entitled under this Agreement or under applicable law.
3.2 Failure to make payment on or before the renewal date will result to account suspension or termination. Account is suspended 5 days after the renewal date while termination will occur 7 days after the renewal date.
3.3 7HostingPH.com is not and shall not responsible for data integrity for any accounts that are suspended, interrupted, disconnected or terminated for non-payment of Services.
4. Account Cancellation.
4.1 Customers may voluntarily cancel their account at any time, for any reason or for no reason, subject to the following:
Collocation. Customer must notify 7HostingPH.com 30 days prior to due date by sending an email to sales [at] 7hostingph.com.
4.2 Customer understands and agrees that 7HostingPH.com will not provide any refunds in connection to account cancellations.
5. Refunds and 45-Day Guarantee.
5.1 Except as explicitly provided in this section, all payments to 7HostingPH.com, including, but not limited to, setup fees and annual fees regardless of usage, are non-refundable.
5.2 Without waiving any of its other rights under the Agreements, 7HostingPH.com offers to its Customers a one-time 45-day money-back guarantee (“45-Day Guarantee”) ONLY on fees for hosting services, but NOT including any of the following fees:
5.2.1 Setup fees;
5.2.2 Fees for domain name registrations and renewals;
5.2.3 Fees charged for exceeding your allotted disk space or bandwidth;
5.2.4 SSL certificate fees;
5.2.5 Any add-on services, features, software; and
5.2.6 Any other fees for services involving a third party. You may not transfer or assign the 45-Day Guarantee to any third party.
5.3 Customer is entitled to a maximum of one (1) 45-Day Guarantee. The 45-Day Guarantee applies only to your first order of Web hosting services from 7HostingPH.com. Changes to your service, including, but not limited to, adding new services, removing services, or changing the type of hosting plan do NOT make you eligible for an additional 45-Day Guarantee. If you have ever previously obtained a refund under the 45-Day Guarantee, whether or not in relation to your existing account, your existing account will be canceled, but no money will be refunded to you.
5.4 The 45-Day Guarantee may be availed by the cancellation of account within forty five (45) days from the start of the Term, by sending a cancellation request email to sales [at] 7hostingph.com, as provided in Clause 4 above. If you do not cancel your account within forty five (45) days of the beginning of your service, your right to the 45-Day Guarantee shall expire forever and may not be revived under any circumstances, without our written approval.
5.5 You will not be eligible for the 45-Day Guarantee if you violate any of the provisions of the Agreements. You agree that you will not circumvent the restrictions on the 45-Day Guarantee described in this document, or attempt to circumvent those restrictions by any means, including, but not limited to, the following actions:
5.5.1 Creating multiple accounts, using the same account name or different account names;
5.5.2 Canceling your account for the sole purpose of obtaining a refund and then registering for a new account;
5.5.3 Organizing multiple business entities or using assumed business names for the purpose of circumventing these restrictions;
5.5.4 Knowingly providing false or inaccurate information when you register for your account; or
5.5.5 Requesting a refund under the 45-Day Guarantee at any time after you have already received a refund under that guarantee.
6. Violation of Laws
6.1 Customer agrees not to engage in any activity that violates any international, foreign, federal, state, or local laws applicable to the service terms described in this Agreement.
6.2 7HostingPH.com reserves the right to discontinue service to any Customer it deems, in its sole discretion, violates any condition of service including, but not limited to, the following:
6.2.1 Acceptable Use Policy
7.1 Customers are responsible for maintaining their own set of account backup.
7.2 7HostingPH.com accounts are backed up daily and weekly. However, these backups are intended for 7HostingPH.com’s administrative purposes only, to allow us to provide excellent service to our customers. As part of its commitment to first-rate customer service, 7HostingPH.com always seeks to create complete and accurate backups of customer accounts.
7.3 7HostingPH.com does not guarantee the completeness, availability, currency and integrity of its backups. Customer understand and agree that 7HostingPH.com’s backup policy does not create, and 7HostingPH.com disclaims, any warranties, expressed or implied, for which 7HostingPH.com can be held liable.
7.4 7HostingPH.com does not provide compensation of any kind for lost, inaccurate, incomplete, or outdated data in the event that 7HostingPH.com backups do not function properly, regardless of the reason(s) for any such malfunction, even if the malfunction was due to the fault or negligence of 7HostingPH.com or any of its employees or agents, and regardless of whether 7HostingPH.com had been informed of the possibility of such malfunction, or any fault or negligence that might cause it.
7.5 7HostingPH.com does not provide backup for Virtual Private Servers, Dedicated Server and Collocated Server otherwise an agreement has been placed.
7.6 In the event that you need to recover data from a backup, 7HostingPH.com will uses reasonable efforts to restore data to your account from the appropriate backup. However, please note this service is intended to complement your own backups to your own computer, and is not a substitute for those backups. Again, 7HostingPH.com does not guarantee the availability, completeness, currency, or integrity of its backups.
7.7 You understand and agree that 7HostingPH.com’s backup policy does not create any warranties for whose breach 7HostingPH.com can be held liable.
